For the purposes of these Terms and Conditions:
• Application means the software program provided by the Company downloaded by You on any electronic device, named “Stand Proud”
• Application Store means the digital distribution service operated by Google Inc. (Google Play Store) or Apple Inc. (Apple App Store) in which the Application has been downloaded.
• Affiliate means an entity that controls, is controlled by or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.
• Country refers to: Athens, Greece
• Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to Tilemachos Papadopoulos
• Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.
• Feedback means feedback, innovations or suggestions sent by You regarding the attributes, performance or features of our Service.
• In-app Purchase refers to the purchase of a product, item, service or Subscription made through the Application and subject to these Terms and Conditions and/or the Application Store's own terms and conditions.
• Service refers to the Application.
• Subscriptions refer to the services or access to the Service offered on a subscription basis by the Company to You.
• Terms and Conditions (also referred as "Terms") mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Service.
• Third-party means any services or content (including data, information, products or services) provided by a third-party that may be displayed, included or made available by the Service.
• You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.
“STAND PROUD” (“the application”), is a mobile application designed to help you correct posture problems and alleviate back pain, through specialized exercise programmes.
Please read carefully these Terms and Conditions and the accompanying Privacy Policy before using “STAND PROUD”.
You automatically accept the Terms and Conditions during the “Sign-up” process after downloading the application by clicking on the “Sign-up” button on your device.
Your access to and use of the services our application provides is conditioned on your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to everyone who completes the “Sign up” process.
If you disagree with any part of the Terms and Conditions you may neither access or use the application or the content and services it provides.
“STAND PROUD” is intended for any person looking to correct his/her posture through specialized exercise programmes and alleviate back pain.
All services “STAND PROUD” provides are subject to these terms and conditions.
You must be at least sixteen (16) years old (within EU) to use the application. If you have not yet reached the minimum age of sixteen, then it is imperative that a parent or guardian reviews these Terms and Conditions and the accompanying Privacy Policy and consents on your behalf for any data processing or use the application under his direct supervision.
Users are responsible for providing and maintaining the equipment (mobile device) and internet connection required to use the application.
Users agree to use “STAND PROUD” only for lawful purposes and in accordance with these Terms and Conditions and the accompanying Privacy Policy.
We may, at out our discretion, suspend your access to or use the application or its services or any its components, due to maintenance (updates, patches, bug fixes, etc.), modification of the services. All updates, maintenance or upgrades will be generally available to you. Even though downloading and installing the updates we provide is not mandatory we cannot guarantee the functionality of our application without them.
Without limiting the foregoing, we reserve the right, in our sole discretion, to suspend or terminate your subscription, revoke any in-app purchases or trial access, and delete your account and all associated content, immediately and without notice, if we determine you have engaged in fraudulent or abusive behavior (including but not limited to automated scraping, bulk downloading, reverse-engineering, redistributing our content, or violating the Terms and Conditions.)
Subject to your compliance with these Terms and Conditions, we grant you a limited, non-exclusive, non-transferable, revocable license to use the content and services provided by “STAND PROUD” for your personal, non-commercial use. The type of license we grant you depends on whether you selected free or premium access to the application (1 month, 6 month and 12 month subscription). The license ends when you delete your account from your device or stop using the services depending on the type of access you selected.
Content includes but is not limited to videos, audio, information, graphics, software, music, data, and any other materials that are available through the use of the application.
You may not sublicense, sell, resell, transfer, assign, distribute, or otherwise commercially exploit or make available the content or services or any intellectual property of the application to any third party.
You agree not to modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the content services of the application, except as expressly permitted by law.
Use the services provided by the application at your own risk.
Our services may not be suitable for everyone.
By signing up to our application you acknowledge that your physician has specifically approved your use of our application and judged your physical condition suitable for the services that the application provides.
It is strongly recommended to not use the application services if you suffer from any medical conditions that discourage exercise such a heart condition, or are in a state unfit for exercise (injured, pregnancy etc.)
Under no circumstances we offer a guarantee that the use of the application will bring the results intended by you or offer a cure of any type. Results depend on several factors that can’t be influenced or covered by the type of exercises the application provides (genetics, type of underlying injuries, current fitness level, the specific medical reason of postural problems and back pain, etc.).
In the event that you feel unwell while performing any of the exercises in our services you should stop immediately and seek the help of a medical professional.
The content and services of this application is not in any way intended as medical advice, diagnosis or treatment for any individual or specific health condition.
“STAND PROUD” should be used exclusively with the understanding that its services and content are intended as a general exercise and educational aid and should be used only after the approval of a suitable physician, that has previously assessed your health and fitness. Nothing in the content and services of this application should be misconstrued as medical advice in the form of either diagnosis or treatment suggestion.
No one affiliated, directly or indirectly with the development or maintenance of this application will be liable for any type of injury that may result, directly or indirectly, from any of the recommended workout plans, workouts or exercises. While we may provide guidelines such as written descriptions, pictures, or videos describing how to perform specific exercises or activities, you assume sole responsibility for performing those exercises or activities with proper form, as risk of injury or illness increases with improper form. It is encouraged to seek multiple sources of information regarding how to perform each exercise correctly and to consider consulting with a qualified coach, instructor, personal trainer, or physical therapist, especially if you are new to any of the forms of training or activity you seek to perform.
Data Protection and Privacy
We are committed to protecting your privacy and personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation (GDPR) and other applicable legal regulations.
We collect and process your personal data only for the purposes outlined in our Privacy Policy.
We will obtain your explicit consent before processing any sensitive personal data related to your health.
We implement appropriate technical and organizational measures to ensure the security and confidentiality of your personal data.
You have the right to access, rectify, or erase your personal data, as well as the right to restrict or object to its processing.
Please refer to the Privacy Policy for more information regarding the use of your personal data.
To use the application, you must download and install it on your mobile devise and then “sign up” by providing a name, an email, a password and automatically accept the Terms and Conditions & Privacy Policy in order to create a user account.
You can also create a user account by using your pre-existing Google account. In case you sign up through an existing Google account, the “sign up” process is completed once you have entered your Google account details and confirmed to use them. Afterwards the application will draw all the relevant information that your existing Google account provides. In the same token, in case you have an iOS device, you can also use your pre-existing Apple account to sign-up.
If you use “Sign-up” (and not “Sign-up with Google” or “Sign-up with Apple”), you are required to confirm your email address by following the instructions sent to the email you provide. This confirmation process is crucial for establishing a reliable line of communication, ensuring that you are informed about updates to our Terms of Service, Privacy Policy, app enhancements, announcements, and any changes in user data handling by our company. Failure to confirm your email address, or providing an incorrect or non-functional email, means that you may not receive these important notifications. Please ensure the accuracy and validity of your email address. STAND PROUD cannot be held responsible for the failure to receive updates and communications due to unconfirmed or inaccurate email addresses provided by the user.
After “signing-up” the application will send a confirmation email to your provided email account and automatically proceed to the “Onboarding” phase where the user inputs the following data:
· Gender
· Height
· Weight
· Birthday
· Workout Experience
· Preferred Plan Duration (6 Weeks, 12 Weeks)
· Workouts Per Week Goal (2 to 5 per week)
· Postural Assessment (The user chooses through relevant images their posture condition)
· Pain Assessment (The user chooses the location of their back pain and its intensity - if any)
After “Onboarding” the user is free to use the content and services of the application that are free. However, the application offers an array of extended content and services that are available only after subscribing for the premium edition of the application.
When installing the application, the contract (between user and developer) regarding the application’s free content and services is formed when you click on the “Sign- Up” button.
The contract regarding the premium tier of the application’s services is formed by paying a one-time fee or as part of a subscription.
We offer subscriptions for the premium tier content for 1, 3 and 12 months. This might be subject to change.
In-app payments for the premium subscriptions and purchases will be executed through Application Store.
Except when required by law, paid Subscription fees are non-refundable.
While we are under no obligation to do so, in certain limited circumstances we may, at our sole discretion, provide you with a refund. If the Subscription has been made through an In-app purchase, the Application Store's refund policy will apply and, in that event, you will have to contact the Application Store directly.
You have the option to cancel the renewal of your subscription either via your account settings page or by reaching out to the us directly. Refunds will not be issued for fees already paid for the current subscription period, and you will retain access to the service until the end of your current subscription period. If your subscription was initiated through an in-app purchase, you can terminate the renewal through the application store.
We retain the authority to modify subscription fees at our discretion and at any point. These changes will be implemented at the conclusion of the ongoing subscription period. Prior to the adjustment, we will provide you with ample notice, allowing you to opt-out of your subscription before the new fees are applied. By continuing to use the service after the fee adjustment takes effect, you agree to pay the revised subscription amount.
Our application may offer in-app purchases that allow you to acquire products, services, or subscriptions. Additional information on managing these purchases through your device can typically be found in the terms and conditions of the application store.
Once initiated, in-app purchases are non-refundable and cannot be canceled after payment and download. They are intended for use exclusively within the application. The are not transferable and cannot be exchanged for cash
It's important to note that billing and transaction processes for in-app purchases are managed by the respective application store and are governed by their terms and conditions. Should you experience any payment-related issues with in-app purchases, please reach out to the application store for assistance.
The application its services its contents, including but not limited to text, graphics, images, videos, and exercises, are owned by Tilemachos Papadopoulos and are protected by other intellectual property laws.
Reproduction, distribution, modification, or creation of derivative works of any content from the application without prior written consent is strictly prohibited. All application content is protected by intellectual property laws.
Within our application, you may encounter links to third-party websites or services that are not operated or managed by us. As we have no control or supervision over the content or services provides by the above third- parties, we cannot be held responsible or liable for any damages or losses resulting from the use of said content or services.
To the fullest extent permitted by law, we disclaim all warranties, express or implied, regarding the accuracy, reliability, or completeness of any information provided in the application.
We shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the application.
We reserve the right to terminate or suspend your access to the application without prior notice for any reason, including but not limited to the violation of these Terms and Conditions.
Upon termination for cause under these Terms, your subscription will be automatically cancelled, any remaining trial or prepaid fees forfeited, and your account and any stored data may be deleted. No prorated refunds will be provided except as required by applicable law or by the policies of the App Store or Google Play.
We reserve the right to modify or revise these Terms and Conditions at any time. Any changes will be effective immediately posted on the relevant section of the application.
Your continued use of the application after the posting of any changes constitutes acceptance of those changes.
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Hellenic Republic and the European Union.
Any dispute arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Piraeus Greece.
When you provide feedback, you are transferring all rights, titles, and interests related to that feedback. In case this transfer is deemed ineffective for any reason, you consent to granting us a non-exclusive, perpetual, irrevocable, royalty-free, worldwide license to utilize, reproduce, disclose, sublicense, distribute, modify, and exploit your feedback without any limitations.
